The terms governing your use of the AxioRCM website and our revenue cycle management services.
1. Acceptance of terms
By accessing the AxioRCM website at axiorcm.com or engaging AxioRCM LLC ("AxioRCM," "we," "us") for services, you agree to these Terms of Service. If you do not agree, do not use the website or our services.
2. Description of services
AxioRCM provides revenue cycle management services to healthcare providers, including medical billing, medical coding, credentialing and provider enrollment, prior authorization, accounts receivable recovery, virtual medical assistance, consulting, and related services. Service availability and scope are defined in each client's service agreement.
3. Engagement and scope of work
A client relationship begins only upon execution of a written service agreement. That agreement defines the specific services, deliverables, service levels, pricing, and term. Information on this website, including any free audit, proposal, or estimate, is informational and does not by itself create a binding engagement.
4. Client responsibilities
To enable AxioRCM to perform services, clients agree to:
- Provide timely, accurate, and complete information, documentation, and system access.
- Maintain their own licensure, payer contracts, and regulatory compliance as the healthcare provider.
- Execute a Business Associate Agreement where AxioRCM will process protected health information.
- Review reports and respond to requests for clarification needed to work claims and denials.
5. Fees and payment
Fees are set out in the applicable service agreement. Medical billing services are typically billed as a percentage of collections; other services may be billed on a fixed-fee or hourly basis. Unless otherwise stated, invoices are due within the period specified in the service agreement. Late amounts may accrue interest as permitted by law.
6. Confidentiality and HIPAA
Each party agrees to protect the other's confidential information. Where AxioRCM processes protected health information on a client's behalf, AxioRCM acts as a Business Associate under HIPAA, and the parties' Business Associate Agreement governs the use, disclosure, and safeguarding of that information. 7. Intellectual property
The AxioRCM website, including its text, design, graphics, and logos, is owned by AxioRCM LLC and protected by intellectual property laws. You may not copy, reproduce, or create derivative works from the website without permission. Client data and records remain the property of the client.
8. Website acceptable use
You agree not to misuse the website, including by attempting to gain unauthorized access, interfering with its operation, transmitting malicious code, or using automated means to scrape content without permission.
9. Disclaimers
The website and its content are provided "as is" without warranties of any kind, express or implied. AxioRCM does not provide legal, accounting, or clinical advice through this website. Statistics and outcomes referenced on the website are illustrative and do not guarantee future results, which depend on factors specific to each practice.
10. Limitation of liability
To the maximum extent permitted by law, AxioRCM is not liable for indirect, incidental, special, or consequential damages arising from use of the website. Liability arising from services is governed by the limitations set out in the applicable service agreement.
11. Indemnification
You agree to indemnify and hold AxioRCM harmless from claims arising out of your misuse of the website or breach of these Terms, except to the extent caused by AxioRCM's own negligence or willful misconduct.
12. Termination
We may suspend or restrict access to the website at any time. Termination of a service engagement is governed by the applicable service agreement, including any notice period and transition obligations.
13. Governing law
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law principles. Any dispute relating to the website will be subject to the exclusive jurisdiction of the state and federal courts located in Sheridan County, Wyoming.
14. Changes to these terms
We may update these Terms from time to time. The effective date above reflects the most recent revision. Continued use of the website after changes constitutes acceptance of the updated Terms.
